I received the following email from the Alumni Association and am forwarding it for your information. This is the second Article 32 hearing that I have been advised of. I reported to you earlier on a similar hearing for a Midshipman 1/C that was held in early June. As I get more information I will pass it on to you in newsletters. Here is the Alumni House email:

This email is being sent to USNA AA Trustees, Foundation Board of Directors, Class/Chapter Presidents, Parents' Club Presidents for further dissemination.

The Navy held an Article 32 hearing on June 30 at the U.S. Naval Academy for two 3rd Class Midshipmen who are charged with several violations of the Uniform Code of Military Justice (UCMJ) ranging from conduct unbecoming an officer, to rape. The charges are based upon an investigation by the Naval Criminal Investigative Service (NCIS). The charges are merely accusations and the accused are presumed innocent until proven guilty.

The name and other personal information of the victims are being withheld to protect their privacy. The U.S. Naval Academy requests the names of the accused and other witnesses be withheld for similar privacy reasons.

An Article 32 hearing in the military is somewhat equivalent to a civilian grand jury proceeding. Navy officials will use the information obtained in this hearing, and the recommendation of the investigating officer, to make decisions regarding the disposition of allegations made in this case.

We expect that there will be media interest in this matter, very soon. Please help us to make it clear to our alumni, parents, and friends that no further details will be forthcoming due to privacy and the fact that this is an on-going investigation. When and if the Academy has information that can be shared with us, we will share it with you.
