I received the following email from the Alumni Association
and am forwarding it for your information. An Article 32 hearing, that
I reported to you earlier, was held in early June for a Midshipman 1/C.
That hearing has resulted in referral to a General Court Martial for the
Midshipman involved. I am unfamiliar with any details of this case and
have no comment to make. Here is the Alumni House email, as well as a

This email is being sent to USNA AA Trustees, Foundation Board of Directors,
Class/Chapter Presidents, Parents' Club Presidents for further dissemination.
The Superintendent of the U.S. Naval Academy has referred the case involving
a Midshipman 1st Class accused of several violations of the Uniform Code
of Military Justice (UCMJ) to a General Court-Martial.
The Midshipman has been charged with violating UCMJ article 92 (Orders
Violation), UCMJ article 120 (Rape), UCMJ article 125 (Sodomy), UCMJ article
133 (Conduct Unbecoming an Officer) and two counts of UCMJ article 134
(Unlawful Entry and Indecent Assault). The charges are accusations, and
the accused is presumed innocent until proven guilty.
The Naval Academy held an Article 32 hearing for the Midshipman on June
2-3, 2003 to investigate these allegations. The Superintendent made the
decision to refer this case to General Court-Martial after considering
all the evidence involved and the recommendations of the Article 32 investigating
officer.
As this matter is now referred to a General Court-Martial, the Academy
will not be able to provide further information on the case to ensure
that the accused receives a fair and impartial trial.

Midshipman Charged
The case of a fourth-year U.S. Naval Academy Midshipman charged under
military law with raping a first-year female student in November was referred
to a general court-martial, an academy official said yesterday.
Vice Adm. Charles W. Moore, the acting superintendent, made the decision
to proceed with the case against Robert A. Curcio after reviewing the
recommendations of an investigating officer, said Cmdr. Rod Gibbons, the
academy's spokesman.
Curcio, 23, of Antioch Calif., has been charged by the academy with raping
a Virginia woman in a Nov. 8 encounter in which Curcio allegedly lured
her into his room, said Greg D. McCormack, Curcio's attorney. Curcio also
has been charged with sodomy in connection with the woman's allegation
that the two students had consensual oral sex Oct. 28, according to McCormack.
A charge that Curcio assaulted the woman March 29 was dropped, McCormack
said. McCormack said the two students had never had sexual relations.
"These allegations are flagrantly false, and we will deal with them
in court," he said.
A trial date has not been set.
